CORRECTION: The following story contains in misstatement based on a typographical error in Rice County Judge Bernard Borene's conclusion in his Feb. 27 ruling. The story should say Borene found WCAL radio is not a charitable trust, which makes St. Olaf's sale of the station allowable.
FARIBAULT — A Rice County Judge Friday ruled that St. Olaf College’s sale of WCAL radio is valid and that the a group fighting to reinstate the station, Save WCAL, is not a charitable trust.
By ruling that Save WCAL is not a charitable trust, Judge Bernard Borene said St. Olaf was not only within its rights to sell the station to Minnesota Public Radio, but could use proceeds from the sale as it saw fit.
In a Saturday press release, David Gonnerman, St. Olaf spokesman said, “The college has always believed its actions regarding the sale to have been proper and that the filing had no merit.
“The judge’s order speaks for itself,” he said. “And St. Olaf remains focused on providing an outstanding education to its students.”
A press release issued earlier Saturday by Save WCAL representatives said Borene’s ruling “is in direct contradiction to the charitable trust principles used and decisions made by Rice County District Court Judge Gerald Wolf (ret.) in the preceding case.
“The SaveWCAL board will now have to determine whether or not to appeal Judge Borene’s decision,” the release said.
